In case of violation of standards, the garbage disposal immediately becomes a source of unpleasant odors, distribution pathogenic microbes and infections, a place of localization and reproduction of household insects and rodents.
In case of non-compliance with fire safety rules, the garbage chute becomes a source of rapid spread of fire and smoke in public spaces: pre-elevator areas, corridors, strollers, back stairs, storage rooms and technical rooms.

In addition, it should be noted that almost all residential buildings with a height of 6 floors and above, built before 2000, are equipped with garbage chutes made of asbestos-cement pipes, which perfectly absorb moisture and correspond to the formation of growths inside the trunk, which contributes to a narrowing of the pipe diameter and the occurrence of blockages .
It is clear that the problem of cleanliness of the garbage chute should be solved by regularly cleaning it with technical means and accompanying disinfection, which, according to sanitary standards, must be carried out by management companies at least once a month, as well as the daily removal of accumulated garbage from the receiving chambers. However, in reality, such a scheme helps, unfortunately, not always and not everywhere, which forces residents apartment buildings increasingly resorting to such a radical measure as sealing the garbage chute completely and switching to a scheme of regularly taking out your garbage into local containers.

In accordance with Article 36 of the Housing Code of the Russian Federation, the garbage chute in apartment building refers to common house property, and responsibility for the maintenance of this shared property lies with the residents. And according to Article 46 of the Housing Code of the Russian Federation, “decisions of the general meeting of owners of premises in an apartment building on issues put to vote are adopted by a majority of votes from total number votes taking part in this meeting of owners of premises in an apartment building.” Therefore, if you want to get rid of an existing garbage chute, then this can only be done with the consent of the resident owners, and no operating company can impose such a decision on them.

It is clear that not all residents of the building will vote for such a decision. In particular, the above-mentioned representatives of groups of citizens with limited mobility will most likely be against it. The situation here can be saved by neighborly mutual assistance: these people can simply put their garbage bags outside the doors of their apartments, and other residents of the entrance will help take them out onto the street.
By the way, a mirror situation is also possible - with the consent of the residents-owners, a previously closed garbage chute can be reopened. This is especially true in cases of new buildings, when management companies, during the period of active move-in of residents, block access to garbage chutes on their own initiative in order to prevent their misuse by dumping there construction waste etc. Accordingly, if the residents themselves agree to continue living without a garbage chute, then there is no need to do anything. If not, then you need to hold a meeting and insist that the management company return the garbage chute to normal condition.
It should be noted that in Europe, installation of garbage chutes in new homes is now almost universally abandoned. However, the situation there is made easier by the culture of separate emission by the population that has been cultivated over the past decades. household waste into appropriate containers. The experience of Belarus is interesting in this regard, where the city authorities of Minsk themselves initiate the closure of garbage chutes in apartment buildings in order to stimulate separate collection waste. For those houses whose residents voluntarily agreed to this step, it is planned to introduce a differentiated tariff for utility bills. In addition, starting this year in the capital of Belarus, it is planned to build new houses without garbage chutes.
It should be noted, by the way, that one of the ways to solve the problem of outdated garbage chutes without closing them is to overhaul them or completely replace them. However, throughout Russia, such actions are carried out centrally only in Moscow, where since 2008 city program overhaul apartment buildings. In other cities, such actions are not part of capital repairs and are not financed from the budget; repairs to the garbage chute can only be carried out at the expense of the residents themselves.

How to solve a problem with an old garbage disposal:

Legal problems with a garbage chute in an apartment building arise partly because there is no separate law regulating the rules for its installation, operation and disposal. When resolving the issue of constructing an internal access receiver, developers rely on the current SNiPs, in particular, the rules and regulations established on January 31, 2013 and a specific clause - 9.3.
The only problem is that since the first edition, these SNiPs have been adjusted several times, including the paragraph that explains when a garbage receptacle must be:
- as amended in 2011 – the receiver should have been built in houses intended for pensioners and the disabled; in other cases, the question was left to local authorities, which took into account the current locality solid waste removal and disposal system;
- in 2016, the rules were clarified: internal waste collection must be organized in houses for pensioners and the disabled with a height of more than 2 floors, and in all other residential buildings with a height of 5 floors or more.
At the same time, SNiPs allow an exception to be made and builders not to spend money on building a waste receptacle in a high-rise building if daily waste removal is organized in containers located on the street. This alternative is also approved by Rosstandart. Thus, developers are not required to include a garbage chute in the project, but its presence increases the comfort of the building and to some extent affects the cost of housing.
About the pros and cons
The system of in-door collection of household waste has its pros and cons, so it is difficult to speak unequivocally about comfort: residents of some houses are happy, while others curse their piggy neighbors and dream of changing apartments.

- the plaintiffs are elderly people and pensioners who find it difficult to take garbage out onto the street;
- the closure of the garbage receptacle was temporary, for example, during the period of cosmetic repairs to the entrance, but after the completion of the work the receptacle did not work;
- the management company did not eliminate the blockage, preferring to simply seal the hatches and place the containers on the street.
Unfortunately, abandoning the garbage chute in an apartment building does not always solve the problem of cleanliness and order.

The legal aspect of abandoning the garbage chute
Refusal of the garbage chute is within the competence of the general meeting of owners of premises in an apartment building. All legal aspects are described in Article 46 of the RF Housing Code.

Thus, according to the law, the consent of all owners is not required to close a garbage chute. A majority of votes (⅔) of the total number of meeting participants is required!
A garbage chute is the common property of the owners of premises in an apartment building. According to Article 36, paragraph 2 of the Housing Code of the Russian Federation, owners have the right to dispose of common property.
It is impossible to appeal to clause 3 of the same article, which states that reducing the size of common property is possible only with the consent of ALL owners. No later than 10 days after the meeting, all residents must be notified that the form of waste collection will change. This can be done in the same ways as in step 1.
