For 80 years now, December 1st has been celebrated around the world as a day of support for people who do not want to take up arms. Despite persecution, they do not give up their beliefs, reject violence and everything related to war.
Conscientious objectors are the topic of today's program.
Avoiding military service becomes the only option for these young men. Despite the fact that the right to alternative civil service is enshrined in the Constitution Russian Federation, conscripts cannot exercise this right in practice.
There is such a word - “necessary”.

Christina Gorelik: In the Moscow studio of Radio Liberty, I talk about the right to alternative civil service with Anna Neistat, director of the Moscow office of the international human rights organization Human Rights Watch, and Sergei Krivenko, head of the Alternative Civil Service program at the Compassion charity center.
In Russia, the number of conscripts is growing every year who are trying by any means to evade military service: they do not sign summons, they are in hospitals, in psychiatric institutions, just to get exemption from military service. If they had a choice between joining the army or alternative civilian service, would the number of such draft dodgers be reduced or not? I have a question for Sergei Krivenko, head of the Alternative Civil Service program.
Sergey Krivenko: I think it would decrease, and there is a reason for this. Even that experiment in Nizhny Novgorod, which was introduced last year by Nizhny Novgorod Mayor Yuri Lebedev, showed that once the right was granted to these guys, somehow the percentage of draft dodgers in Nizhny Novgorod decreased. And the figures were mentioned that almost doubled, about 4 thousand guys who did not go to the military registration and enlistment offices and evaded summonses and so on, during the fall conscription, when this right to alternative service was introduced, 2 thousand people there were, that is, almost twice as many.
Christina Gorelik: But this experiment, as far as I know, was declared invalid by the court. Or is that not true?
Sergey Krivenko: This is wrong. Everything is more complicated there. Some guys, namely 12 people, are still working, and they were drafted by the draft board, that is, everything was done according to the law. And as if nothing threatens them legally. True, they are naturally subject to enormous moral and political pressure from the military registration and enlistment office and the prosecutor's office.
Christina Gorelik: I have a question for the director of the Moscow office of Human Rights Watch. Or maybe it all just depends on the climate in the army? If there were no hazing, hazing, if there were normal conditions, young men would willingly go to military service, and the issue of alternative civilian service would not be so pressing.
Anna Neistat: On the one hand, this is certainly true. On the one hand, our research shows that, of course, the huge percentage of draft dodgers in Russia is associated with the catastrophic situation in the army itself. Moreover, we're talking about not only about hazing and the constant cycle of violence and humiliation, but also about such more mundane things as, for example, lack of food, the absolutely catastrophic situation with medical care and other.
At the same time, it seems to me that this should not be confused with alternative service, since there is also such a thing as conscientious objection to service. Not due to reluctance to serve in rather unpleasant conditions, but precisely because of conviction. And such a right should be given to a person in any situation.
Christina Gorelik: I have a question for Sergei Krivenko.
Does a conscript have to prove his convictions? Well, for example, if a conscript, as the song says, is simply afraid of shots, he is not a member of any anti-militarist organization, and he does not have religious beliefs prohibiting him from taking up arms - does he have the right to simply refuse military service in favor of alternative civilian service, or not?
Sergey Krivenko: In fact, we understand that beliefs cannot be proven. This is the kind of matter that is not subject to rough evidence. The only example in history, as far as I know, is when the Holy Inquisition tried to somehow develop methods of evidence.
We managed to slightly soften this situation in the law. In that original version, the law (and let me remind you that the law was developed by the General Staff and submitted to the government in January of this year, the law that was adopted this summer on alternative civil service) provided for precisely the concept of evidence of convictions. There a procedure was prescribed in which the guy had to prove his convictions. We managed to soften this situation, and now the phrase “substantiate beliefs” is used, that is, the guy must write some kind of detailed essay and submit certificates from his previous place of work, some petitions, he can invite some people who will confirm his position. That is, this is not proof. He must simply justify his beliefs, but not prove them.
Christina Gorelik: That is, in principle, everything will depend on his talent as a writer, or not?
Sergey Krivenko: It is difficult to understand how this will happen in Russia. Because in Germany, for example, this process, where alternative service has been going on for about 40 years, this process has also undergone changes. In the first years, in the first two decades, this was difficult to prove. It was necessary to prove the beliefs. There were conflicts there, many were sent to the army. But now it’s enough to write such a detailed essay, expanded, and often this solves it. There are very few refusals.
Christina Gorelik: The Law on Alternative Civil Service will come into force in January 2004. I know that they took an active part in the development of this law public organizations. To what extent were their wishes taken into account?
I asked this question to Evgeny Gontmakher, head of the Department social development apparatus of the Russian government.
Evgeniy Gontmakher: These organizations actually fulfilled their role very well. They participated very actively, and there were many specific proposals on their part, which, by the way, were taken into account in the law.
But the law that was finally adopted, of course, did not suit civil society. It is a fact. Well, this is our political reality. That is, it was accepted political decision of such kind. We can, of course, discuss it now, we can say that, so to speak, we did not fully take into account the opinion civil society. But let’s say this: the law itself contains a lot of innovations that were invented by public organizations.
But not everything they proposed was taken into account. Therefore, there is dissatisfaction on their part. What should I do? The law, I think, is not eternal, right? After all, laws are regularly revised. Now military reform is being developed. In this regard, it may also be necessary to amend the law on alternative service. Therefore, also for civil organizations Not everything is lost.
Christina Gorelik: This was Evgeny Gontmakher, head of the Department of Social Development of the Russian Government.
Sergey, do you share the optimism of Evgeniy Gontmakher?
Sergey Krivenko: Well, it's the same for me as for him, complicated attitude to the law, although I consider the very fact of the adoption of the law an outstanding victory. In fact, for the first time since 1939 in the Soviet Union, and then in Russia, the right to conscious refusal of military service was legalized. And although the law was not adopted the way we wanted, we can start working with it. And there are opportunities, we will probably change it, and we will do this in all areas.
Christina Gorelik: I would like to ask a question to Sergei Krivenko.
What specific proposals of public organizations were taken into account in the law on alternative civil service?
Sergey Krivenko: Well, probably everyone knows that public organizations lobbied for, developed, and helped pass a completely different model of alternative civil service. But this year we were faced with the fact that the bill that the government introduced was moving like a locomotive without stopping, and nothing could be done about it. Therefore, we made every effort to somehow soften the provisions of the bill. And we succeeded.
If in the original version it was stated that service should be carried out only on an extraterritorial basis, this was softened, now it is “as a rule”. If it was impossible to get an education before, you can now get evening or correspondence education. If labor was not actually regulated, it is now strictly stated that the work of a conscript is regulated in accordance with the Labor Code.
Of course, this may seem like a small limitation. Also, here's another one important points: it was possible to add the opportunity to serve in organizations or enterprises that are subordinate to authorities local government. And these are the ones who need the guys to work. True, this service will have to be developed by a separate bill, which we are now starting to prepare.
These may seem like very small changes, but in fact they allow a well-prepared guy to choose his place of work and prove that he does not want to go to military unit work, but wants to work here, and so on.
The law is very inconvenient. There are two repressive provisions: this is, first of all, a term, of course, a gigantic term, and indeed the possibility of being sent without consent to military units and to everything related to military sphere. But convinced pacifists, a convinced person who wants to make a normal alternative service, can try to prove and try to fight for this.

So what should the guys do until the law on alternative civil service comes into force? I have a question for Anna Neistat, head of the Moscow branch of the international human rights organization Human Rights Watch.
Anna Neistat: First of all, it must be said that, in accordance with Russian legislation, the call can be appealed. Appeal either to a higher draft commission or directly to the court. And in this sense, we, of course, recommend appealing it directly to the court.
We know good results, especially in other Russian cities. Let's say, not in Moscow and not in St. Petersburg, but, say, in Novokuznetsk there are a number of cases won in this way.
Another question is that very often the military registration and enlistment office itself does not allow this right to be realized, since the decision of the draft commission is not issued - and very often it is not issued even after urgent requests from the parents or the conscript himself - to issue such a decision. And without a written decision, it is very difficult to appeal it in court. Therefore, we insist that this entire procedure must be clearly spelled out in legislation in order for this right to appeal to become real.

Sergey Krivenko: Yes. You know, yes, there are such cases. And persecution, fortunately, due to the fact that we have a very humane democratic constitution, adopted, which has direct action, and which enshrines the right to conscientious objection to military service, the prosecution is not criminal in nature. That is, the number of criminal cases initiated in connection with the fact of refusal after 1993 amounts to only a few, and this is due to the fact that when such cases are initiated, the guy simply could not prove it in court or filled out the papers incorrectly. That is, the judicial procedure is very difficult, and here you need to follow all sorts of rules.
And the most famous cases of persecution are famous case Dmitry Neverovsky, who spent 6 months in prison for his refusal; Then, naturally, we managed to close this criminal case.
Many criminal cases are being initiated. If a guy does everything correctly, if he goes to court and proves his convictions in court, and doesn’t run, doesn’t evade, but really makes a conscious refusal, then it’s impossible to imprison such a person, because the constitution provides the right to replace an alternative civil service.

Anna Neistat: You know, first of all, I must correct: not all countries have, firstly, the right to alternative civil service enshrined in law, and secondly, even in some foreign countries Where this right is enshrined in law, the situation is similar to the Russian one.
However, in principle, we can say that conscription service in itself does not contradict international law, international law. Another question is that here, perhaps, three main points must be observed. The first thing is that there must be a procedure for conscription into the army clearly defined by law, taking into account appeals and a number of other factors. Secondly, this procedure must be applied in practice, and not just exist on paper (and in this sense, Russia has serious problems). And, finally, of course, the right to conscientious objection to military service must be enshrined in law and, again, exist in practice as a real right.
Christina Gorelik: Sergei wanted to add something. Sergey Krivenko, head of the Alternative Civil Service program.
Sergey Krivenko: I just wanted to answer the question why the length of service is so long - both in the army and in the alternative civilian service.
In fact, our military institute, one might say, is the only area that has not been reformed since 1991. And in fact we have - Soviet army. In the new democratic Russia what remains is the Soviet Army, which lives and exists according to those laws (and conscription, by the way), is carried out according to those laws that were adopted in 1939 (well, really, with minor changes there, in 1994 - 1995, they managed to liberalize it a little). And here we are - the heirs of the militarized Soviet Union, and that says it all.
Christina Gorelik: Now I would like to speak separately about the Western experience of creating an alternative civil service using the example of Germany.
In Germany, to get into the civilian service instead of the military, you just need to declare your desire. Moreover, a German youth can undergo alternative service not only in his own country, but also abroad.

Evgeniy Bovkun: The possibility of refusing to serve in the army was provided for in the first legislative acts in Germany. The 1949 constitution states: “No one may be forced against his conscience to carry out military service in arms.”
In 1956, a law on universal conscription was adopted, in which for the first time the motivation for refusal on moral grounds appeared; instead of conscription into the Bundeswehr, work in civilian institutions was allowed. And in 1960, a special law on alternative service came into force, defining its conditions and terms, which varied depending on the duration of military service. In 1984, an alternative soldier had to serve 20 months, now - 10. As always, 2 months more than a soldier.
In the 1970s, the alternative service was renamed civilian, and a little later the so-called “other” service appeared. It was established for those who would like to provide assistance in the implementation of social projects abroad. The children are placed at the disposal of humanitarian unions and societies, which, in turn, contact foreign colleagues. They do not receive money for their work, being on the payroll of the receiving party.
Two school friends from Stuttgart chose the harsh reality of Russia over a months-long and comfortable trip to London to study in English. In Moscow they became assistants charitable organization"Ivanushka", which serves disabled children. None of the German alternative specialists who gained experience caring for the sick, disabled and elderly in Russia have regretted this so far. Satisfaction with the knowledge of one's own relevance makes up for difficulties, say returnees.
