EFFICIENCY OF HEATING SUPPLY FACILITIES
1. This Procedure is intended to monitor indicators of the technical and economic condition of heat supply systems (with the exception of heat-consuming installations of consumers of thermal energy, coolant, as well as thermal energy sources operating in the mode of combined generation of electrical and thermal energy), including indicators of physical wear and tear energy efficiency of heat supply facilities.
2. Monitoring of indicators of the technical and economic state of heat supply systems is carried out by executive authorities of the constituent entities of the Russian Federation in the field of heat supply in relation to heat supply systems of settlements, urban districts (with the exception of heat consuming installations of consumers of thermal energy, coolant, as well as heat energy sources operating in combined generation mode electric and thermal energy), including indicators of physical wear and tear and energy efficiency of heat supply facilities, in accordance with clause 7.2 of part 2 of article 5 of the Federal Law of July 27, 2010 N 190-FZ “On Heat Supply” (Collected Legislation of the Russian Federation, 2010 , No. 4159; No. 3263; No. 4590, No. 7359; ; 2013, Art. 2330; 1, art. 38).
3. Based on the results of a technical inspection and drawing up a report, heat supply and heating network organizations send information on the indicators of the technical and economic condition of heat supply systems provided for by this order to the authorized executive body of the constituent entity of the Russian Federation, and also post this information on the organization’s website in the information telecommunications network "Internet".
4. In case of changes in the indicators of the technical and economic condition of heat supply systems, heat supply and heating network organizations send the relevant information in the manner established by paragraph 3 of this procedure.

having considered the complaint of KAISHA LLC on grounds of violation of Article 17 of the Federal Law of July 26, 2006 No. 135-FZ “On the Protection of Competition” (hereinafter referred to as the Law on the Protection of Competition),
U S T A N O V I L A:
On January 30, 2018, the Kirov OFAS Russia received a complaint from KAISHA LLC (hereinafter referred to as the Applicant) against the actions of the Organizer of the auction - the administration of the Luzsky municipal settlement of the Luzsky district of the Kirov region during an open competition for the right to conclude a concession agreement in relation to heat supply and hot water supply facilities on the territory of the Luzsky urban settlement (notice No. 071217/0130347/01), lot No. 1.
The applicant indicates that the report on the technical inspection of municipal property, which is part of the tender documentation, was drawn up in violation of the requirements of Federal Law dated July 27, 2010 No. 190-FZ “On Heat Supply,” as well as the Order of the Ministry of Construction and Housing and Communal Services of the Russian Federation dated August 21. 2015 No. 606-pr (clause 16). In addition, the specified tender documentation does not contain copies of the finished accounting (financial) statements of the organization servicing the object of the concession agreement. Thus, the tender documentation was drawn up in violation of the requirements of clauses 12, 13, part 1, art. 46 of the Law on Concession Agreements. It is believed that the lack of information under consideration does not allow us to assess the real state of heat supply facilities, as well as to calculate the necessary costs for organizing an accident-free operation of heat supply facilities, the costs of current and major repairs, as well as to draw up an investment program and other feasibility calculations and justifications laid down the basis of the tender proposal.
In connection with the above, he requests to consider the arguments specified in the appeal and, based on the results of consideration of the complaint, issue an order to the auction organizer to eliminate the violation of antimonopoly legislation.
The consideration by the antimonopoly authority of a complaint about a violation of the bidding procedure is carried out in accordance with and in accordance with the procedure of Art. 18.1 of the Law on Protection of Competition.
The Kirov Office of the Federal Antimonopoly Service of Russia sent a notice to the Applicant, the Organizer of the bidding, regarding the consideration of the complaint with a request to suspend the bidding regarding the conclusion of the concession agreement. Documentation on the competition, protocols of the competition commission were requested from the auction organizer, and written explanations on the complaint were also requested.
The consideration of the complaint is scheduled for 02/07/2018 at 13:00. 30 min.
At the commission meeting on 02/07/2018, the applicant, duly notified of the date, place and time of consideration of complaint No. 02/05-18zh, supported the arguments set out in the complaint. Additionally, he explained that Appendix No. 5 to the concession agreement “Tasks and list of measures for repair and reconstruction of the Agreement Object” contains information on the necessary measures, indicating only planned expenses without their economic justification. Prepared financial statements of the organization servicing the object of the concession agreement are necessary in order to establish the actual flow of funds for servicing the objects. The organization that previously served heat supply facilities is known, but the legal entity’s financial statements could not be found in the public domain. However, such information on the site cannot meet the criteria of reliability. The absence of this information does not allow a potential participant in the competition to economically justify the volume of proposed investments, which, in turn, is a criterion for the competition and is of significant importance.
The representative of the Organizer of the auction explained that the applicant did not indicate in his complaint how his rights and legitimate interests were violated. LLC "KAISHA" did not contact the Organizer of the auction with a request to clarify the tender documentation, as well as to familiarize itself with the property and technical documentation in order to assess the real condition of the heat supply facilities. LLC "KAISHA" did not take any actions that indicated the Company's intention to participate in the competition. The website www.admluza.ru contains the Heat Supply Scheme for the Luzsky urban settlement of the Luzsky District of the Kirov Region, which reflects all the necessary technical and economic indicators. Thus, the applicant could familiarize himself with information that is in the public domain. The competition documentation, as well as the draft concession agreement, were agreed upon by the Government of the Kirov Region and other executive authorities of the Kirov Region; there were no comments on the content of the documentation. The report on the technical inspection of municipal property was compiled based on the information that was at the disposal of the local government body. The administration of the Luzsky urban settlement has repeatedly sent requests ref. No. 146 of 01/25/2017, ref. No. 180 of January 27, 2017, ref. No. 190 of January 30, 2017, ref. No. 363 dated February 17, 2017, requiring the provision of annual accounting (financial) statements, as well as information necessary for the preparation of tender documentation. However, the legal entity did not provide the requested information. It is believed that the applicant’s arguments do not indicate significant violations; the lack of information specified in the complaint did not prevent two other business entities from submitting applications for participation in the competition. They ask that the complaint be declared unfounded.
The Commission, having listened to the explanations of the representatives of the Applicant, the Organizer of the auction, and having familiarized itself with the presented documents, decided that for an objective and comprehensive consideration of the case it is necessary to request additional documents from the persons participating in the case.
In this connection, on the basis of Part 14.1 of Art. 18.1 of the Law on Protection of Competition, consideration of complaint No. 02/05-18zh was postponed to 02/14/2018 at 14:00. 45 min.
The Applicant and the Auction Organizer were duly notified of the date, place and time of consideration of complaint No. 02/05-18zh.
On 02/14/2018, the Kirov OFAS Russia received a written petition from the Applicant, in which a representative of KAISHA LLC objects to the consideration of the complaint in his absence, and asks to postpone the consideration of the complaint, having notified him properly.
The Commission of the Kirov OFAS Russia, guided by the fact that earlier the Applicant, while setting out his position, fully supported the arguments of the complaint, no additions to the complaint were received in the case materials, makes a decision to refuse the application of KAISHA LLC and considers it possible to continue consideration of complaint No. 02 /05-18zh in the absence of a representative of KAISHA LLC.
At the commission meeting on February 14, 2018, representatives of the Organizer of the auction fully supported the previously stated arguments and considered the complaint of KAISHA LLC to be unfounded. Additionally, they reported that the Report on the technical condition of municipal property reflects objective data on the quantitative and qualitative characteristics of the property. The specified data is sufficient to assess the condition and operational potential of heat supply facilities. The reason for generating a report in this volume was the lack of a technical report on the part of the resource supply organization LLC IC “Razvitie”. Currently, municipal property is assigned under the right of economic management to the municipal unitary enterprise “Luzsky Utility Systems”, created by decree of the administration of the Luzsky urban settlement of the Luzsky district of the Kirov region No. 258 dated 08/21/2017. At the time of drawing up the tender documentation and sending it for approval to the Government of the Kirov Region (letter ref. No. 1057 dated May 17, 2017), the unitary enterprise had not been created, therefore, it could not carry out a technical inspection. The administration did not have the financial ability to attract another authorized organization to carry out a technical inspection of the property.
Having studied the materials available in the case, written explanations, and arguments of representatives, the commission of the Kirov OFAS came to the following conclusions:

- Boiler house building with equipment and heating networks, one-story, metal walls, area 79.7 sq.m., 2001, located at the address: Luza, st. Dorozhnikov, 1B. The length of the networks is 531 running meters.
- Boiler house building with equipment and heating networks, one-story, brick, area 248.5 sq.m., 1976, located at the address: Luza, st. V. Kozlova, 7B. The length of the networks is 844 linear meters.
- Boiler house building with equipment and heating networks, one-story, brick, area 257.9 sq.m., 1968, located at the address: Luza, st. Zavodskaya, 35A. The length of the networks is 1785 running meters.

In accordance with clause 12, part 1, art. 46 Federal Law of July 21, 2005 No. 115-FZ “On Concession Agreements” (hereinafter referred to as the Law on Concession Agreements) on a concession agreement, the object of which is heat supply facilities, centralized hot water supply systems, cold water supply and (or) wastewater disposal, individual objects of such systems, in the tender documentation in addition to the conditions established Article 23 of this Federal Law also includes:
a copy of the report on the technical inspection of the property transferred by the concessionaire to the concessionaire under the concession agreement, prepared in accordance with the requirements of regulatory legal acts of the Russian Federation in the field of heat supply, in the field of water supply and sanitation.
According to Part 11 Article 23 Federal Law dated July 27, 2010 No. 190-FZ “On Heat Supply” (hereinafter referred to as the Heat Supply Law), a technical inspection of heat supply facilities is carried out in order to determine their technical characteristics, taking into account the results of the industrial safety examination of heat supply facilities provided for legislation Russian Federation in the field of industrial safety of hazardous production facilities. Requirements for conducting a technical inspection of heat supply facilities are established by the methodology for comprehensive determination of indicators of the technical and economic condition of heat supply systems, provided for clause 14 of part 2 of article 4 of this Federal Law.
The commission of the Kirov OFAS Russia rejects the argument of the Auction Organizer about the non-use of the right by KAISHA LLC to familiarize itself with the property, as well as sending a request for clarification of the tender documentation.
The reluctance of an economic entity to exercise the right to contact the Auction Organizer with a request for clarification of documentation and to become familiar with the property does not exclude the obligation of the Auction Organizer to post the information provided for in Part 1 of Art. 46 of the Law on Concession Agreements. Violation of the procedure for posting information about bidding established by regulatory legal acts is significant.
In addition, it was established that the Report on the technical inspection of municipal property was signed by a person who, by virtue of clauses 4, 15 of the Methodology, was not authorized to carry out these actions - the head of the administration of the Luzsky urban settlement, S.V. Teterin.
During the consideration of the complaint, representatives of the Organizer of the auction pointed out the lack of a technical report on the part of the resource supplying organization LLC IC “Razvitie”, necessary for generating a technical inspection report in full, as well as the lack of financial and time resources to attract an authorized organization.
At the same time, it has been established that the municipal property, which is the subject of the concession agreement, is assigned the right of economic management to the municipal unitary enterprise “Luzsky Utility Systems”, created by decree of the administration of the Luzsky urban settlement of the Luzsky district of the Kirov region No. 258 dated 08/21/2017.
Thus, the Organizer of the auction did not confirm the presence, at the time of posting the notice of the competition, of objective circumstances preventing the implementation of a technical survey and the preparation of a report on its results by the organization carrying out regulated activities in the field of heat supply - MUP "Luzskie Utility Systems".
Also, the Commission of the Kirov OFAS Russia has not established the compliance of the provisions of the Report on the technical inspection of property with Appendix No. 5 to the concession agreement “Tasks and list of measures for repair and reconstruction of the Agreement Object” (in terms of technical characteristics of the equipment). Thus, the information presented in the Report (Appendix No. 12) does not allow us to correlate the amount of work and financial costs during the maintenance of facilities (Appendix No. 5) with conclusions about the technical condition of the property and a description of the technical characteristics.
Having studied the submitted tender documentation, the Commission comes to the conclusion that the Report on the technical inspection of municipal property (Appendix No. 12 to the concession agreement) does not contain the information required for placement specified in clause 16 of the Methodology.
Also clause 13, part 1, art. 46 of the Law on Concession Agreements contains a requirement to include in the tender documentation a copy of the annual accounting (financial) statements for the last three reporting periods of the organization that operated the property transferred by the concessionaire to the concessionaire under the concession agreement, if this organization operated this property in some period. or moment during the specified periods and was obliged to maintain accounting records in accordance with the legislation of the Russian Federation on accounting.
It has been established that currently the organization operating the property transferred under the concession agreement is the Luzskie Utility Systems Municipal Unitary Enterprise.
At the time of posting the notice on December 7, 2017, the municipal unitary enterprise Luzskie Communal Systems, which has been servicing heat supply facilities since 2017, could not provide annual accounting (financial) statements for 2017 before the end of the financial year.
In accordance with Part 2 of Art. 18.1 of the Law on the Protection of Competition in the event that an appeal against the actions (inaction) of the auction organizer, the operator of the electronic platform, the tender or auction commission is associated with a violation of the procedure established by regulatory legal acts for posting information about the auction, the procedure for filing applications for participation in the auction, such actions may may also be appealed to the antimonopoly authority by another person (applicant), whose rights or legitimate interests may be infringed or violated as a result of violation of the procedure for organizing and conducting tenders.
The applicant did not justify how the absence of accounting (financial) statements as part of the competition documentation limits his right to submit an application for participation in the competition.
Along with the prohibitions established part 1 Article 17 of the Law on the Protection of Competition, during tenders, if the organizers of the tenders are local government bodies, as well as in the case of procurement of goods, works, services to meet state and municipal needs, restriction of access to participation in tenders not provided for by law is prohibited ( part 2 of article 17 Law on Protection of Competition).
Placing in the bidding notice a copy of the technical inspection report of the property transferred by the concessionaire to the concessionaire under the concession agreement incompletely significantly violates the rights and interests of potential participants to receive reliable information, which in turn leads to limited access to information required for posting.
The inability to familiarize yourself with such information in the message creates an objective threat to the participant in the competitive procedure misperceiving his rights and obligations to fulfill the contract. This circumstance may lead to restriction of access to participation in tenders due to the impossibility of adequate understanding of the consequences of the occurrence of obligations, which violates the prohibition established part 2 of article 17 Law on Protection of Competition.
The commission of the Kirov OFAS Russia came to the conclusion that potential bidders were deprived of the opportunity to participate in the auction due to failure to receive complete information about the object of the concession agreement, and the established violations of the procedure for conducting the auction resulted in gross violations of the rights and legitimate interests of an indefinite number of persons of potential auction participants.
The Commission believes that the violation of antimonopoly legislation occurred through the fault of the Organizer of the auction - the administration Luzsky urban settlement of Luzsky district, Kirov region .
When deciding on the issue of eliminating violations of legislation, the Commission comes to the conclusion that eliminating violations of antimonopoly legislation is possible by issuing an order to the administration of the Luzsky urban settlement of the Luzsky district of the Kirov region to cancel an open competition for the right to conclude a concession agreement in relation to heat supply and hot water supply facilities in the territory of the Luzsky urban settlement .
Based on the above, guided by Part 17, Part 20 of Art. 18.1, part 1 art. 23 of the Federal Law of July 26, 2006 No. 135-FZ “On the Protection of Competition” commission,
DECISION:
- Recognize the complaint of KAISHA LLC as justified in connection with the violation by the Organizer of the auction - the administration of the Luzsky urban settlement of the Luzsky district of the Kirov region, Part 2 of Art. 17 of the Law on the Protection of Competition during an open competition for the right to conclude a concession agreement in relation to heat supply and hot water supply facilities on the territory of the Luzsky urban settlement (notice No. 071217/0130347/01, lot No. 1).

1. This Methodology is intended for a comprehensive determination of indicators of the technical and economic condition of heat supply systems (with the exception of heat-consuming installations of consumers of thermal energy, coolant, as well as thermal energy sources operating in the mode of combined generation of electrical and thermal energy) (hereinafter referred to as heat supply systems), in including indicators of physical wear and tear and energy efficiency of heat supply facilities.
2. Comprehensive indicators of the technical and economic condition of heat supply systems, including indicators of physical wear and tear and energy efficiency of heat supply facilities (hereinafter referred to as complex indicators of the technical and economic condition of heat supply systems) are determined on the basis of information on the technical and economic indicators of heat supply and heating network organizations contained in heat supply scheme for a settlement or urban district, approved in accordance with Requirements to the procedure for developing and approving heat supply schemes approved resolution Government of the Russian Federation dated February 22, 2012 N 154 (Collection of Legislation of the Russian Federation, 2012, N 10, Art. 1242; 2014, N 41, Art. 5546).
3. In order to determine the compliance of the actual technical and economic indicators of heat supply and heating network organizations with the standard values of such indicators contained in the duly approved heat supply scheme for a settlement, urban district, as well as the indicator of physical wear and tear, a technical inspection of heat supply facilities is carried out in the cases provided for Federal law dated July 27, 2010 N 190-FZ “On Heat Supply” (Collected Legislation of the Russian Federation, 2010, N 31, Art. 4159; 2011, N 23, Art. 3263, N 30, Art. 4590, N 50, Art. 7359; 2012, Art. 3446, Art. 7643; 2013, Art. 2330, Art. 3477; Art. 4218, No. 42, Art. 5615, Art. 6913, No. 38). Technical inspection of heat supply facilities is carried out taking into account the results of the industrial safety examination of heat supply facilities provided for legislation Russian Federation in the field of industrial safety of hazardous production facilities.
4. Technical inspection of heat supply facilities is carried out by organizations carrying out regulated activities in the field of heat supply, independently or with the involvement of specialized organizations.
5. The objects of technical inspection in accordance with this Methodology are all objects of heat supply systems that meet the requirements Article 2 Federal Law of July 27, 2010 N 190-FZ “On Heat Supply”.
6. The scope of work for technical inspection includes:
a) desk examination;
b) technical inventory of property, including full-scale, visual and measurement surveys and instrumental inspection of heat supply facilities.
7. When conducting a desk inspection of heat supply facilities, regulatory and technical documentation is reviewed, including information on the technical condition, accident rate of heat supply facilities, service life and wear and tear of heat supply facilities, as well as the compliance of the actual technical and economic indicators of heat supply and heating network organizations with the standard values of such indicators contained in the heat supply scheme of a settlement or urban district approved in the established manner.
8. In the absence of technical information, a design diagram of the facilities is drawn up - the basis for a full-scale inspection of heat supply systems.
9. If organizations have accounting information systems created for centralized maintenance and updating of data on the location, technical characteristics of heat supply facilities, as well as accounting, operational, repair and other information reflecting the technical condition of the facilities, a desk examination is carried out based on the analysis of information from such information systems
10. Based on the results of the analysis of regulatory and technical documentation for heat supply facilities, the following information should be established:
a) about the year of construction of heat supply facilities;
b) the date of commissioning of heat supply facilities;
c) about the material, diameter of pipelines, their actual condition, percentage of wear;
d) on the accident rate of heat supply facilities for the period from the date of the previous technical inspection, and in the case of a technical inspection in accordance with these requirements for the first time - over the last 5 years;
e) on modernization and reconstruction work, as well as emergency and other repair work at heat supply facilities, indicating the exact locations (addresses) of such work, their actual volumes, the results of the work performed (the impact of the work results on the functioning of the systems);
f) on the presence or absence of the technical ability to provide heat supply in accordance with the requirements established by law.
11. Technical inventory of heat supply facilities is carried out on the basis of a technical inspection plan with determination of technical inventory parameters for each inventory facility formed by an organization carrying out regulated activities in the field of heat supply, based on a desk examination.
12. Technical inventory of heat supply system facilities includes:
a) field survey of the location of objects and determination of the main technical parameters;
b) visual measurement examination, including:
external and internal inspection of objects;
assessment of the technical condition of inspection objects based on the totality and nature of visually observed defects, damage, and coolant leaks;
comparison of data on heat supply facilities obtained during a desk examination with the actual characteristics of systems established during a visual measurement examination;
c) selective instrumental examination, carried out in the event that desk and visual measurement examinations do not allow achieving the goals of the technical examination, including diagnostics of pipelines; search for coolant leaks using instrumental methods, diagnostics of objects; measurement of the actual characteristics of the equipment, instrumental examination of the equipment, including, if necessary, partial or complete disassembly of the equipment.
13. Based on the results of the technical inventory, the following are determined:
a) the level of actual wear and tear of heat supply system facilities;
b) the current technical condition of the objects on the date of the survey;
c) deadlines for repairs or reconstruction of facilities.
14. Wear of pipelines and other structures inaccessible for inspection is determined by service life as the ratio of the actual service life to the average standard service life.
In cases where the actual service life approaches the standard or exceeds it, and the estimated service life of the structure, determined by expert analysis, exceeds the standard period, the percentage of wear is determined by the ratio of the actual service time to the sum of the service life and estimated service life.
15. Based on the results of completion of the technical inspection, a report on the results of the technical inspection (hereinafter referred to as the report) is drawn up, containing the results of the technical inspection, signed by an authorized person of the organization carrying out regulated activities in the field of heat supply.
16. The report contains:
a) a list of objects in respect of which a technical inspection was carried out;
b) a list of parameters, technical characteristics, actual performance indicators of an organization carrying out regulated activities in the field of heat supply, or other indicators of heat supply facilities identified during the technical inspection;
c) description of identified defects and violations with reference to a specific object with the attachment of photographic materials, results of instrumental studies (tests, measurements);
d) conclusion on the technical condition of the heat supply system facilities;
e) assessment of the technical condition of the heat supply system facilities at the time of the inspection;
f) conclusion on the possibility, conditions (modes) and timing of further operation of heat supply system facilities;
h) recommendations, including proposals on planned values of reliability and energy efficiency indicators, on operating modes of the inspected facilities, on measures indicating deadlines for their implementation (including carrying out major repairs and implementing investment projects) necessary to achieve the proposed planned values of reliability indicators , and energy efficiency, recommendations on ways to bring heat supply system facilities to the condition necessary for further operation, and possible design solutions. 2. Monitoring of indicators of the technical and economic state of heat supply systems is carried out by executive authorities of the constituent entities of the Russian Federation in the field of heat supply in relation to heat supply systems of settlements, urban districts (with the exception of heat consuming installations of consumers of thermal energy, coolant, as well as heat energy sources operating in combined generation mode electrical and thermal energy) including indicators of physical wear and energy efficiency of heat supply facilities, in accordance with clause 7.2 of part 2 of article 5 Federal Law of July 27, 2010 N 190-FZ “On Heat Supply” (Collected Legislation of the Russian Federation, 2010, N 31, Art. 4159; 2011, N 23, Art. 3263; N 30, Art. 4590, N 50, Art. 7359, Art. 3446; Art. 7643; Art. 2330; Art. 30, Art. 4218; No. 5615; Art. 6915;

Based on the results of a technical inspection and drawing up a report, heat supply and heating network organizations send information on the indicators of the technical and economic condition of heat supply systems provided for by this order to the authorized executive body of the constituent entity of the Russian Federation, and also post this information on the organization’s website in the information telecommunications network "Internet".
4. In case of changes in the indicators of the technical and economic condition of heat supply systems, heat supply and heating network organizations send relevant information in the manner established paragraph 3 real order.
